1. Provider and scope
These Terms govern access to Voxern Rank Tracker, provided by VOXERN, obrt za usluge i trgovinu, vl. Robert Dusper, Drniška 15 A, 21220 Okrug Gornji, Croatia (“Voxern”, “we”). By creating an account or ordering a plan, you agree to these Terms. Mandatory consumer rights always remain unaffected.
2. Eligibility and accounts
You must be at least 18 years old and legally capable of entering a contract. If acting for an organisation, you confirm that you may bind it. Provide accurate account information, protect your credentials and promptly report unauthorised access.
3. The service
Voxern monitors and reports search-result positions for domains, keywords, devices, locations and languages selected by the user. Paid base plans provide Google rank tracking. Plan limits, update frequency, optional add-ons, features and current prices shown on the pricing and checkout pages form part of the contract.
Search positions are estimates obtained from third-party data sources. They can vary because of location, device, personalisation, search-engine testing, index changes and other factors outside our control. Voxern does not guarantee a particular ranking, traffic level or SEO outcome.
Where ChatGPT Visibility is used, Voxern submits user-selected prompts and optional locale settings for sampled OpenAI model checks with web search. During the free trial, Weekly AI is enabled. On paid subscriptions, automatic Weekly AI is an optional recurring add-on; while enabled, the same numeric limit applies to active AI prompts as to the base plan's keyword-device checks, and each eligible active prompt receives one automatic sampled check every 7 days. Manual AI checks remain available for 1 shared credit without the add-on. The scheduler distributes the weekly allowance across the week. If an account retains more active prompts after a downgrade or add-on cancellation, automatic checks stop or rotate as the applicable entitlement requires without deleting saved history. Brand and domain matching is performed locally by Voxern after the response is returned; Voxern does not inject the tracked target into an otherwise non-branded prompt. If the user includes a brand or domain in the prompt itself, that text is submitted as part of the chosen prompt. The service may record sampled responses, detected mentions, cited sources and technical check metadata. Generated results can vary between checks and may differ from answers displayed in the consumer ChatGPT application. Voxern does not guarantee a mention, citation, recommendation, traffic result or universal AI rank.
4. Trial and plan limits
New accounts currently receive a seven-day Starter trial, including 5 daily Google keyword-device checks, Weekly AI enabled for 5 active prompts during the trial, and 50 shared check credits. No payment card is required. One keyword tracked on one device is one keyword-device check; tracking the same keyword on desktop and mobile counts as two checks. After the trial, paid base plans are Google-only unless the user expressly selects the optional Weekly AI add-on. Trial or promotional terms may be withdrawn for new registrations without affecting trials already granted.
5. Orders, payment and renewal
Prices are shown in EUR per month unless clearly stated otherwise. Payments are processed by Stripe. Before payment, checkout identifies the selected Google-only base plan, any optional Weekly AI add-on, the recurring amount and billing interval. The AI checkbox is not preselected. Paid subscriptions and enabled recurring add-ons renew automatically for the same interval until renewal is cancelled.
You may manage the base subscription through the Stripe billing portal and enable or disable Weekly AI from your account where available, or contact kontakt@voxern.com. Stripe prorates add-on changes: enabling creates a prorated charge adjustment and disabling creates an unused-time credit adjustment, normally applied on the next Stripe invoice. This does not guarantee an immediate collection or cash refund. We will give reasonable advance notice of a material price increase and allow cancellation before it applies.
6. Shared check credits
Automatic Google checks included with the base plan and automatic AI checks included with an enabled Weekly AI add-on do not consume credits. A manual Google keyword-device check or manual AI prompt check requested with Check now each reserves 1 credit from the same shared balance. Manual AI does not require the add-on. If a manual AI check fails without delivering a usable result, its reserved credit is returned to the account balance. Additional shared credits may be purchased through the account. Purchased or promotional credits have no cash value, are not transferable and may be restricted to the account to which they were issued, subject to mandatory law.
7. Consumer withdrawal
Consumers generally have 14 days from conclusion of a distance contract to withdraw without giving a reason. See Consumer Rights and use the online withdrawal function. If you expressly request immediate performance and withdraw during that period, you may be charged only the proportionate amount for service already supplied.
8. Acceptable use
You may not interfere with security or availability; attempt unauthorised access; introduce malicious code; scrape or overload the service; resell account access without permission; violate law or third-party rights; or enter special-category personal data or unnecessary personal information into keywords, prompts, project names or other fields.
9. User data
You retain rights in information you submit and grant Voxern a limited licence to host, process and transmit it only as needed to operate, secure and support the service. You are responsible for having a lawful basis to submit any personal data.
10. Intellectual property
Voxern and its licensors retain all rights in the software, interface, design, documentation and branding. An active plan grants a limited, non-exclusive, non-transferable right to use the service for its intended purpose.
11. Third-party services
The service relies on providers including Stripe for payments, DataForSEO for Google rank and keyword data, and OpenAI for sampled model responses and web-search sources used by ChatGPT Visibility. Third-party services may change or interrupt their systems. Voxern is independent and is not affiliated with or endorsed by Google or OpenAI.
12. Availability and changes
We use reasonable care to keep the service available but do not promise uninterrupted operation unless a separate service-level agreement expressly applies. We may make reasonable technical, security or legal changes and will notify users before a change materially reduces an active paid service where reasonably possible.
13. Suspension and termination
Access may be suspended for non-payment, a security risk, unlawful use or a material breach. Except in urgent cases, we will provide notice and a reasonable opportunity to remedy the issue. Account data is handled as described in the Privacy Policy.
14. Liability
Nothing excludes liability that cannot lawfully be limited, including mandatory consumer rights. For business customers only, and to the extent permitted by law, Voxern's aggregate contractual liability is limited to fees paid for the affected service during the preceding 12 months, and indirect or consequential business losses are excluded.
15. Complaints and dispute resolution
Written complaints may be sent by email or post using the Legal Notice details. We acknowledge them without delay and answer in writing within 15 days. Consumers may also contact the Croatian Chamber of Trades and Crafts, Court of Honour or Mediation Centre, Ilica 49/II, 10000 Zagreb, Croatia. Participation is assessed for the individual dispute.
16. Governing law
Croatian law applies. Consumers retain any mandatory protection granted by the law of their habitual residence. Courts are determined under mandatory jurisdiction rules.
17. Changes to these Terms
We may update these Terms for legal, security or reasonable service reasons. Material changes affecting an active paid subscription will be notified in advance and will not retrospectively remove accrued rights.
